User Agreement

Welcome to 08 services!

Before using the services, you should read and comply with the 08 User Service Agreement (hereinafter "this Agreement") and the Privacy Policy Terms. Please read carefully and fully understand all provisions, especially those that exempt or limit liability, jurisdiction and applicable law provisions, and any separate agreements for activating or using a particular service. Limitation and disclaimer provisions may be highlighted in bold or underlined to draw your attention.

When you fill in the information on the registration page, read and agree to this Agreement, and complete the entire registration process, or when you actually use the services in any other manner permitted by 08, you are deemed to have fully read, understood, and accepted the terms of this Agreement. You may not thereafter claim that this Agreement is invalid or request its revocation on the grounds that you have not read the contents of this Agreement or have not received answers from 08 to your inquiries.

If you are under 18 years of age, please read this Agreement accompanied by your legal guardian, and pay special attention to the provisions regarding minors' use.

I. Contracting Parties

This Agreement is jointly concluded between the user who uses 08 services through the 08 mobile client software and other means, and 08.

II. Agreement Content and Effectiveness

The content of this Agreement includes the body of this Agreement and all privacy policies, policies, rules, statements, notices, warnings, prompts, and explanations (hereinafter "Rules") that have been or may in the future be published. The aforementioned Rules are an inseparable part of this Agreement and have the same legal effect as the body of the Agreement.
08 has the right to formulate and modify this Agreement and related Rules from time to time as needed. Once the amended Agreement and Rules are published, they immediately supersede the original Agreement and Rules and take effect automatically. If you do not agree with the relevant changes, you should immediately stop using 08 services. If you continue to use 08 services or engage in any website activity, you are deemed to have accepted the amended Agreement and Rules.

III. Service Content

08 provides mobile client iOS version, Android version, and other forms of service software (subject to what 08 provides). 08 will continue to enrich the terminals and forms for you to use the services. This Agreement automatically applies to your use of all versions of the software and services.
08 grants you a non-exclusive license to use the 08 software. You may make one copy of this software for backup purposes only. The backup copy must contain all copyright information contained in the original software. All other rights not expressly granted in this clause or other provisions of this Agreement remain reserved by 08. You must obtain separate written permission from 08 to exercise these rights. 08's failure to exercise any of the foregoing rights does not constitute a waiver of that right.
The service content includes but is not limited to technical functions supporting contacts, conversations, unread message lists, etc. These functional services may be optimized or modified according to changes in user needs, due to different service versions or the unilateral judgment of the service provider, or temporarily suspended due to periodic or non-periodic maintenance.
At the same time, 08 reserves the right to change, upgrade, modify, or transfer the services or any part of the services and their related functions and application software at any time at its own discretion. You agree that 08 is not required to notify you of the above actions and bears no responsibility to you or any third party.

IV. Registration and Account Management

You confirm that when you complete the registration process or actually use the services in any other manner permitted by 08, you should be a natural person, legal entity, or other organization with full civil rights capacity and civil conduct capacity corresponding to the civil acts engaged in. If you do not have the aforementioned qualifications, please do not use the services; otherwise, you and your guardian shall bear all consequences arising therefrom, and 08 has the right to cancel (permanently freeze) your account and claim compensation from you and your guardian.
You should submit true, accurate, complete, and current identity and other related information when registering. You understand and agree that you promise that the account name, avatar, and other information registered shall not contain illegal or harmful information, shall not impersonate others, shall not register for others without permission, shall not register or set up 08 accounts in a way that may cause other users to misidentify, and shall not use usernames that may infringe on the rights of others (including but not limited to suspected trademark and reputation infringement). Otherwise, 08 has the right to refuse registration or stop services and recover the 08 account, and any resulting losses shall be borne by you.
You may use the phone number you provide or confirm, or other methods permitted by 08, as an account for registration, and promise that the registered account name, avatar, and profile information shall not contain illegal or harmful information, shall not impersonate others, shall not register for others without permission, shall not register accounts in a way that may cause other users to misidentify, and shall not use usernames that may infringe on the rights of others (including but not limited to suspected trademark and reputation infringement). Otherwise, 08 has the right to refuse registration or stop services and recover the account, and any resulting losses shall be borne by you.
You understand and agree that the ownership of 08 registered accounts belongs to 08. After registration, you only obtain the right to use the account. The right to use a 08 account belongs only to the initial applicant and may not be transferred or provided to others in any way. Otherwise, 08 has the right to immediately recover the account without notice, and you shall bear all losses arising from the clearing or loss of all data and information generated by your use of the services.
After you successfully register, 08 will confirm your identity based on the account and password. You should properly keep your terminal, account, and password, and take full responsibility for all activities carried out using the account and password (including but not limited to clicking to agree online or submitting various rules and agreements or purchasing services, sharing information or images, initiating voice calls, etc.). You promise to immediately notify 08 when your password or account is used without authorization or when other security issues occur, and you agree and confirm that 08 is not responsible for any direct or indirect loss or damage arising from the above circumstances. Unless required by law or judicial ruling and with 08's consent, your account and password may not be transferred, gifted, or inherited in any way (except for property rights related to the account).

V. Service Usage Standards

Users fully understand and agree that 08 only provides a service platform for users, and you shall be responsible for all acts and results of using the services. Accordingly, you should understand that using 08 services may involve risks from illegal or improper acts (or information) of others. You should judge and act on your own and bear the corresponding risks.
You shall bear the costs incurred from using the services, including but not limited to internet traffic fees and communication service fees.
Unless otherwise stated, the services under this Agreement may only be used for non-commercial purposes. You promise not to copy, duplicate, sell, resell, or use any part of the services or the use or acquisition of the services for advertising and any other commercial purposes.
You promise not to use the services for any illegal or improper activities, including but not limited to the following:

4.1 Uploading, transmitting, or sharing information containing any of the following:

(a) Opposing the basic principles established by the constitution;

(b) Endangering national security, leaking state secrets, subverting state power, or undermining national unity;

(d) Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;

(e) Undermining national religious policies, promoting cults and feudal superstitions;

(f) Spreading rumors, disrupting social order, or undermining social stability;

(g) Spreading obscenity, pornography, gambling, violence, murder, terror, or instigating crime;

(h) Insulting or defaming others, infringing on the lawful rights of others;

(i) Containing false, fraudulent, harmful, coercive, privacy-infringing, harassing, infringing, defamatory, vulgar, obscene, or other morally offensive content;

(j) Containing other content restricted or prohibited by local laws, regulations, rules, ordinances, and any legally binding norms;

4.2 Impersonating any person or institution, or falsely stating or claiming to be associated with any person or institution in a false or deceptive manner;

4.3 Forging titles or manipulating identification data in other ways to make people mistakenly believe that the content was sent by 08 or its affiliates;

4.4 Uploading, transmitting, or sharing any content that you know but are not entitled to transmit based on any law, contract, or legal relationship (such as internal information, proprietary and confidential information known due to employment relationships and confidentiality agreements);

4.5 Uploading, transmitting, or sharing content suspected of infringing the rights of others (including but not limited to copyrights, patent rights, trademark rights, trade secrets, and other intellectual property rights);

4.6 Stalking or harassing others in any way, or sending large amounts of messages to friends or other users through the services;

4.7 Uploading, transmitting, or sharing any advertising, promotional information, promotional materials, "junk mail," "spam," "chain letters," "direct sales," or any other form of solicitation materials; dedicated areas or functions for the aforementioned purposes are excluded;

4.8 As the services are not designed for certain specific purposes, you may not use the services for important areas including but not limited to nuclear facilities, military use, medical facilities, and transportation and communications. If failures in the above operations due to software or service reasons result in personal injury, property damage, or environmental damage, 08 does not bear legal responsibility;

4.9 Engaging in any behavior beyond the normal purpose of internal or external information communication and exchange between friends or users;

4.10 For purposes beyond normal information communication and exchange between friends or users (including but not limited to sending advertising, spam, harassment, or illegal information), forming friend relationships with other users through self-adding or inducing others to add in any way (friend relationships include but are not limited to one-way and two-way friend relationships, the same below); sending large amounts of information to friends or other users through the services;

4.11 Violating laws and regulations, national interests, citizens' lawful interests, public order, social morality, and information authenticity;

4.12 Engaging in any behavior that violates local laws, regulations, rules, policies, and normative documents.

You promise not to engage in the following behaviors regarding the software and services:

5.1 "Uploading, posting, emailing, or otherwise transmitting software viruses or other computer code, files, and programs that interfere with, destroy, or limit the function of any computer software, hardware, or communication equipment";

5.2 Interfering with or destroying the services or servers and networks connected to the services, or violating any regulations, procedures, policies, or norms regarding the network connection of the services;

5.3 Modifying or forging instructions and data during software operation to add, delete, or change the functions or operating effects of the software, or operating or disseminating to the public the software and methods used for the above purposes, whether for commercial purposes or not;

5.4 Logging in or using the software and services through third-party software, plugins, add-ons, or systems not developed or authorized by 08, or creating, publishing, or disseminating the above tools;

5.5 Interfering with the software and its components, modules, and data by yourself, authorizing others, or using third-party software.

You promise to strictly comply with this Agreement (including the Rules mentioned in Article I) when using 08 services.
You agree and accept that 08 is not required to monitor the data and information you upload, transmit, or share at all times, but 08 has the right to review, supervise, and take corresponding actions regarding your use of the services, including but not limited to deleting information, suspending or terminating services, and reporting to relevant authorities.
You promise not to use the services in any form to infringe on 08's commercial interests, or to engage in any behavior that may cause damage or disadvantage to 08.
You understand and agree that during the provision of 08 services, 08 and its affiliates or their authorized units and individuals have the right to place various commercial advertisements or other types of promotional information in various ways, and you agree to receive the above advertisements or promotional information sent to you by email or other means.
You fully understand and agree that you must be responsible for all actions under your registered account, including any content you publish and any consequences arising therefrom. You should judge the content you encounter when using the services and bear all risks arising from the use of the content, including risks arising from reliance on the accuracy, completeness, or usefulness of the content. 08 cannot and will not be responsible for any loss or damage you suffer as a result of the aforementioned risks.
If 08 discovers or receives reports from others that you have violated this Agreement, 08 has the right to delete and block relevant content at any time without notice, and take measures including but not limited to recovering the account, restricting, suspending, or terminating your use of part or all of the services, and pursuing legal responsibility.

VI. Service Fees

Any free trial or free features and services of the services shall not be deemed as 08 waiving the right to charge fees in the future.
You shall pay for internet fees and other communication and information fees charged by third parties that may be incurred from using the services.

VII. Special Authorization

When you make any form of commitment to 08's affiliates, and the relevant company has confirmed that you have violated the commitment, 08 has the right to immediately take restrictive measures on your account in the manner agreed in your commitment, including but not limited to suspending or terminating services to you, and publicizing your breach as confirmed by the relevant company. You understand and agree that 08 does not need to verify facts with you or obtain your consent separately for the relevant confirmation, and 08 does not need to bear any responsibility to you for such restrictive measures or publicization.
Once you violate this Agreement or other agreements signed with 08, 08 has the right to notify 08's affiliates in any way to request them to take restrictive measures on your rights, including but not limited to requesting 08's affiliates to suspend or terminate part or all of the services provided to you, and to publicize your breach on any website under their operation or actual control.

VIII. Third-Party Applications

08 allows third-party applications to access the service platform, and you can obtain third-party application services including but not limited to OA software directly from 08. You understand and agree that 08 only acts as a platform provider, and the relevant applications are independently provided by the third party. 08 does not bear any responsibility for your use of such applications.
You understand and agree that if 08 adjusts, suspends, or terminates the services or any part thereof, thereby affecting third-party application services, 08 does not bear any responsibility.

IX. Service Suspension or Termination

You agree that given the special nature of internet services, 08 has the right to suspend, terminate, or cause the suspension or termination of the services or any part thereof at any time; for the suspension or termination of free services, 08 is not required to notify you.
You understand and agree that 08 has the right to independently determine its business strategy. In the event of a merger, division, acquisition, or asset transfer of 08, 08 may transfer the relevant assets under the services to a third party; 08 may also, after notifying you unilaterally, transfer part or all of the services under this Agreement to a third party for operation or performance. The specific transferee is subject to 08's notice.
If any of the following breaches exists, 08 may immediately suspend or terminate services to the user and require the user to compensate for losses:

3.1 The user violates the registration obligations under Article IV;

3.2 The user violates relevant laws and regulations or the provisions of this Agreement;

3.3 As required by law or competent authorities;

3.4 For security reasons or other necessary circumstances.

X. Privacy Policy

The account you register with 08 services has password protection to ensure the security of your basic information. Please keep your account and password information safe.
08 strives to take various reasonable physical, electronic, and managerial security measures to protect your information, so that the information and communication content stored in 08 will not be leaked, damaged, or lost, including but not limited to SSL, encrypted storage of information, and data center access control. 08 has also taken strict management of employees or outsourced personnel who may have access to information, including but not limited to taking different permission controls based on positions, signing confidentiality agreements with them, and monitoring their operations. 08 will provide corresponding security measures according to existing technology to protect your information and provide reasonable security. 08 will at all times do its best to ensure that your information is not leaked, damaged, or lost, but please also note that there is no absolutely perfect security measure on the information network, so please keep relevant information safe.
08 has the right to independently determine the maximum storage period of your data in the software and services, the maximum storage space of data in the server, etc. based on actual circumstances. You should keep your terminal, account, and password safe, and properly keep relevant information and content. 08 is not responsible for data loss or theft caused by your own reasons, or for deletion or storage failure of relevant data in the software and services.

XI. Intellectual Property

You understand and agree that unless 08 states otherwise, all intellectual property rights (including but not limited to copyrights, trademark rights, patent rights, trade secrets, etc.) and related rights of all products, technologies, software, programs, data, and other information (including but not limited to text, images, pictures, photos, audio, video, colors, and layout design) contained in the services under this Agreement are owned by 08 or its affiliates.
You should ensure that, unless you obtain written authorization from 08, you shall not (and shall not allow any third party) engage in behaviors including but not limited to renting, lending, selling, distributing, copying, modifying, reprinting, compiling, publishing, reverse engineering, reverse assembling, reverse compiling, or otherwise discovering source code with respect to the above rights.
The Logo, "08", and other text, graphics, and their combinations involved in 08 services, as well as other 08 logos, product and service names, are trademarks of 08 and its affiliates in the local area and other countries. Users may not display, use, or otherwise handle them in any way without written authorization from 08, nor may they indicate to others that they have the right to display, use, or otherwise handle them.
You understand and agree to authorize 08 to use your name, trademark, and logo in promotion and marketing, but only to indicate that you are a customer or partner of 08.

XII. Limited Liability

The services will be provided on an "as is" and "as available" basis. 08 hereby expressly declares that it makes no express or implied warranties regarding the services, including but not limited to warranties of applicability, absence of errors or omissions, continuity, accuracy, reliability, or suitability for a particular purpose.
08 makes no commitments or guarantees regarding the effectiveness, accuracy, correctness, reliability, quality, stability, completeness, and timeliness of the technologies and information involved in the services.
Under no circumstances shall 08 be responsible for the inability to provide services or delayed services caused by Internet connection failures, computer, communication, or other system failures, power failures, strikes, labor disputes, riots, uprisings, insurrections, insufficient productivity or means of production, fires, floods, storms, explosions, force majeure, wars, government actions, orders of international or domestic courts, or inaction of third parties.
Whether foreseeable or not, and regardless of the form of behavior, 08 is not responsible for any special, direct, indirect, punitive, sudden, or causally related damages or any other damages (including but not limited to loss of profits or interest, business interruption, and data loss) caused by the following:

4.1 Use or inability to use the services;

4.2 Costs incurred from purchasing or obtaining any products, samples, data, information, or conducting transactions through the services, or other alternative behaviors;

4.3 Unauthorized access or modification of data or data transmission;

4.4 Statements or actions made by third parties through the services;

4.5 Other service-related events, including negligence, that cause damage.

You fully understand and agree that given the special nature of the internet system and environment, the information and personal data you share in the services may be copied, reposted, tampered with, or used for other illegal purposes by others; you have fully realized the existence of such risks and confirm that such risks shall be borne entirely by you, and 08 does not bear any responsibility.
You understand and agree that during the use of the services, there may be risks from any other person's threatening, defamatory, offensive, or illegal content or behavior, or infringement of others' rights (including intellectual property), and anonymous or impersonating information. Based on the service usage standards, such risks shall be borne by you, and 08 does not bear any responsibility.

XIII. Breach of Contract and Compensation

If 08 discovers or receives reports from others that you have violated this Agreement, 08 has the right to delete and block relevant content at any time without notice, and take measures including but not limited to restricting, suspending, or terminating your use of the 08 account and services, restricting, suspending, or terminating your use of part or all of the services (including but not limited to deleting contacts, restricting the addition of members, restricting sending messages or adding friends, etc.), and pursuing legal responsibility.
You agree that if any third party makes any claim or request to 08 and its affiliates arising from or resulting from information you upload, transmit, or share through the services, your use of other functions of the services, your violation of this Agreement, or your infringement of any rights of others, or if 08 and its affiliates suffer any losses as a result, you agree to make full compensation (including but not limited to reasonable attorney fees).

XIV. Valid Notices

Any notice sent to you by 08 may be sent by email, public area announcement on the page, personal network area prompt, mobile phone text message, or regular mail, and such notice shall be deemed delivered or effective to the user from the date of sending.
You agree that any notice you send to 08 should be sent to the email, mailing address, fax number, and other contact information officially published by 08 or communicated to users as described in Article 12.1, or delivered using other notification methods recognized by 08.

XV. Dispute Resolution and Others

The interpretation and application of this Agreement, and any disputes related to this Agreement, shall be handled in accordance with the laws of the People's Republic of China.
If any provision of this Agreement is deemed invalid or unenforceable, the above provision may be severed, and the remaining parts shall remain legally effective.
08's waiver of the rights stipulated in this Agreement in the event of user negligence or breach shall not be deemed a waiver of its rights regarding other or subsequent similar negligence or breach by the user.
This Agreement shall supersede all oral and written agreements, arrangements, understandings, and communications previously reached between the parties regarding any matter of this Agreement.
08 has the right to transfer all rights and obligations under this Agreement to its affiliates based on business adjustments. The transfer will be notified in the manner stipulated in this Agreement, and users promise not to object.

XVI. Others

If you have any comments or suggestions regarding this Agreement or the services, you may contact 08 customer service, and 08 will provide you with necessary assistance.
